A trademark is a unique brand name or logo that is used to differentiate your brand from others in the industry. It can be a word, letter, number, phrase, symbol, shape or a combination of these. You need trademark registration for the legal protection of your brand name/logo. A company/individual should register the trademark in order to possess the complete ownership of the mark and to protect the same from misuse by another person/business entity. If the trademark is not registered, the owner of the mark shall not be entitled to initiate any legal proceedings against anyone to prevent or to recover damages for the infringement of the trade mark. Any trademark that is identical to an existing registered trademark or the trademark for which the application of registration has already been made, cannot be registered.

Type of Trademark That Can Be Considered

Under the Indian trademark law the following are the types of trademarks that can be registered :

  • Product trademarks: are those that are affixed to identify goods.
  • Service trademarks: are used to identify the services of an entity, such as the trademark for a broadcasting service, retails outlet, etc. They are used in advertising for services.
  • Certification trademarks: are those that are capable of distinguishing the goods or services in connection with which it is used in the course of trade and which are certified by the proprietor with regard to their origin, material, the method of manufacture, the quality or other specific features
  • Collective trademarks: are registered in the name of groups, associations or other organizations for the use of members of the group in their commercial activities to indicate their membership of the group.
  • Sound Marks: are those where sound is used to perform the trademark function of uniquely identifying the commercial origin of products or services.

Documents Required for Registration

  • Address of Applicant(s) filing the application.
  • Nature of the entity filing the application (individual/proprietor/partnership firm/ company/ HUF/ LLC).
  • Nature of products/services for which the logo/ mark is used- try to be as specific as possible.
  • Nature of your business (Manufacturer/ Trader/ Service provider).
  • If the mark is already in use then the approximate date since when the mark has been in used in India.
  • Date of the first commercial use of the mark anywhere in the world.
  • A copy of the mark/logo (preferably soft copy) for which trademark is sought.
  • A signed Power of Attorney (Form TM-48) on Stamp Paper in favour of the Trademark Agent/ Advocate.
